Terms and Conditions of Sale

This is an English translation of the Italian Terms and Conditions. In case of any difference between the two versions, the Italian version prevails.

1. Seller

This sales contract is concluded between the buyer (hereinafter the "Customer") and:

2. Subject of the contract

This contract governs the purchase of the Prompt Pack per Coach, Counselor e Operatori Olistici (Prompt Pack for Coaches, Counsellors and Holistic Practitioners), a digital product consisting of 147 prompts (text and AI images) and 10 Custom GPTs spread across 11 categories, accessible through a personal link sent by email.

The product is entirely digital: no physical goods are delivered and no printed material is sent.

3. Price and payment

The price of the Prompt Pack is €27.00 (VAT included), as a single payment. Payment is made through Stripe (credit/debit cards, Apple Pay, Google Pay). Once payment is complete, a Stripe receipt/invoice is generated automatically and sent by email.

4. Delivery of the digital product

The product is delivered immediately after payment is confirmed, by an email containing a personal access link. Delivery takes place within a few seconds of purchase. If the email has not arrived within 15 minutes of purchase, the Customer is asked to contact consulenza@marcomunich.com.

5. Right of withdrawal: exclusion

Under Article 59(1)(o) of Legislative Decree 206/2005 (the Italian Consumer Code), the 14-day right of withdrawal for distance contracts does not apply to contracts for the supply of digital content not on a tangible medium, where the consumer has expressly agreed to performance beginning before the end of the withdrawal period and has acknowledged that they would lose the right of withdrawal.

By ticking the checkbox on the purchase page, the Customer expressly confirms:

• that they want to receive the digital content immediately;
• that they are aware this request means losing the right of withdrawal.

For the reasons above, no refund is provided after purchase.

6. Refund policy

Since this is a digital product delivered immediately and the Customer has expressly waived the right of withdrawal as stated in section 5, the purchase price is not refunded.

Cases of technical error that prevent access to the product are excepted: in that case the Customer can contact consulenza@marcomunich.com for immediate assistance.

7. Product updates and availability

The Seller undertakes to keep the product accessible and to provide the future updates included in the purchase at no extra cost. The Seller reserves the right to change the contents of the Prompt Pack over time, provided that the overall value of the product does not decrease.

8. Limitation of liability

The Prompt Pack is a tool to support content creation. The Seller does not guarantee specific results from the use of the prompts. The Seller's liability is limited to the purchase price of the product.

9. Privacy

The processing of the Customer's personal data is governed by the Privacy Policy available on this website.

10. Governing law and competent court

This contract is governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction. For disputes with customers acting for business or professional purposes, the court of Vicenza has jurisdiction. For any complaint you can write to consulenza@marcomunich.com.
